ENGAGEMENT & SERVICE AGREEMENT 1. PURPOSE. This Engagement & Service Agreement ("Engagement") supplements the Terms of Service and applies to the specific services you have requested from Garcia Multi-Services LLC ("Garcia"), which may include tax preparation and electronic filing, bookkeeping, payroll, sales-tax filings, business formation, ITIN assistance, notary, translation, and related multi-services. The detailed scope, deliverables, and price for each service are reflected on the invoice or written work order issued for that service. 2. RELIANCE ON CLIENT INFORMATION. Garcia will prepare deliverables based exclusively on information, documents, and representations you provide. You represent that all information furnished is true, accurate, and complete. Garcia is not engaged to audit, verify, or independently investigate the underlying data, and is not responsible for errors caused by missing, inaccurate, or misleading information. 3. RECORD RETENTION. You are responsible for maintaining your original records, including W-2s, 1099s, receipts, mileage logs, invoices, bank statements, and supporting schedules, for the period required by law (generally a minimum of three (3) years, and seven (7) years for material understatements). Garcia may retain copies of work product for our own compliance purposes but is not your record-keeper. 4. REVIEW & AUTHORIZATION TO FILE. Before any return, form, or filing is transmitted, you will be presented with a draft to review. By signing or e-signing the authorization (such as IRS Form 8879), you confirm the return is true, correct, and complete to the best of your knowledge and authorize Garcia to transmit it on your behalf. 5. FEES; DEPOSITS; NON-REFUNDABLE WORK. Fees are due as stated on the invoice. Deposits and any time already worked are non-refundable once preparation has begun. Bank-product fees, software fees, e-file fees, and third-party charges are pass-through and non-refundable. Past-due balances accrue interest at the lesser of 1.5% per month or the maximum legal rate. 6. CHANGES, AMENDMENTS & ADDITIONAL WORK. Adding forms, schedules, dependents, business activity, prior-year returns, amended returns, audit response, IRS/state correspondence, or any work outside the original scope will be billed at Garcia's then-current rates after written or in-app approval. 7. COMMUNICATION & DEADLINES. To meet filing deadlines, you must deliver complete documents and approvals by the dates Garcia communicates. Garcia is not responsible for missed deadlines, penalties, or interest caused by your late delivery, unreachable contact information, or failure to respond. 8. NO LEGAL OR INVESTMENT ADVICE. Garcia does not provide legal advice, investment advice, or representation in court. Where such advice is needed, you agree to consult a licensed attorney or financial advisor. 9. CONFIDENTIALITY & DISCLOSURE AUTHORIZATION. Garcia will safeguard your information consistent with the Privacy Notice and 26 U.S.C. § 7216. You authorize Garcia to use and disclose your tax-return information only as needed to perform the requested services, to communicate with tax authorities about your matter, and as you separately authorize in writing. 10. AUDIT RESPONSE. Preparation of a return does not include representation before the IRS or any state. If you receive a notice or are selected for examination, Garcia will assist on a separate, billable engagement subject to availability and licensure. 11. TERMINATION & FILE HANDOVER. Either party may terminate this Engagement in writing. Upon termination, Garcia will, on request, return originals you provided and, on payment of any outstanding balance, a copy of completed deliverables. Garcia may retain work product internally for compliance and quality-control purposes. 12. INCORPORATION OF OTHER AGREEMENTS. The Terms of Service and Privacy Notice are incorporated by reference. Where any conflict arises, the more specific written engagement document for the service controls. By signing, you accept this Engagement & Service Agreement and authorize Garcia to begin work on the services described.
